Acceptance of Terms

These Terms and Agreement ("Terms") are a binding agreement between you and Lukhoo LLC ("Lukhoo," "we," "us," or "our") governing your access to and use of Lukhoo.com, the Lukhoo web and mobile applications, client portal, related pages, features, recordings, communications, and services. Lukhoo was formerly operated, branded, or referenced as Safe-Watcher. Any reference to Safe-Watcher in older materials, files, links, messages, receipts, or account history is deemed a reference to Lukhoo LLC and the Lukhoo services unless the context clearly requires otherwise.
By creating an account, accessing the services, uploading content, starting a recording, using an alert feature, or otherwise using Lukhoo, you agree to these Terms, our Privacy Policy, and our Client Data Privacy Policy. If you do not agree, do not use the services.
Eligibility and Accounts
- You must be at least 18 years old, or the age of legal majority where you live, to use Lukhoo.
- You are responsible for all activity under your account and for keeping login credentials confidential.
- You must provide accurate information and promptly update it when it changes.
- We may suspend or terminate access if we reasonably believe your account is unlawful, unsafe, fraudulent, abusive, or in violation of these Terms.
Important Safety and Legal Disclaimer
- Lukhoo is a recording, documentation, communication, and information-management tool. Lukhoo is not a law firm, emergency response provider, security company, insurance provider, government agency, or law-enforcement agency.
- Lukhoo does not provide legal advice, does not create an attorney-client relationship, and does not guarantee any legal outcome, police response, emergency response, case result, evidence admission, or user safety outcome.
- If you believe there is an emergency or immediate threat to safety, contact 911 or local emergency services immediately. Do not rely on Lukhoo as your only safety measure.
- You are solely responsible for using Lukhoo lawfully, safely, and without interfering with law enforcement, emergency personnel, court orders, investigations, or the rights of others.
Recordings, Location, Transcripts, and Consent
- Lukhoo may allow you to record video, audio, location information, timestamps, transcripts, notes, incident details, and related metadata. You authorize Lukhoo to process and store that information to provide the services.
- You are responsible for knowing and following recording, wiretap, consent, privacy, evidence, and data-protection laws that apply where you use Lukhoo.
- You must not record, upload, share, or request information in a way that violates another person's rights or applicable law.
- Transcripts, summaries, alerts, maps, GPS data, timestamps, and other automated outputs may be incomplete or inaccurate and should be reviewed before reliance.
Attorney and Professional Services
- If Lukhoo allows you to contact, find, request, or communicate with attorneys or other professionals, those professionals are independent third parties and are not employees, agents, partners, or representatives of Lukhoo unless expressly stated in writing.
- Lukhoo does not endorse, guarantee, supervise, or control any attorney's advice, fees, availability, professional judgment, licensure, or results.
- Any attorney-client relationship exists only between you and the attorney who expressly agrees to represent you. Lukhoo is not responsible for professional advice or services provided by third parties.
User Content and License
- You retain ownership of videos, audio, transcripts, messages, incident details, uploaded files, and other content you submit or create through Lukhoo ("User Content").
- You grant Lukhoo a limited, worldwide, non-exclusive license to host, store, copy, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, support, improve, enforce, and comply with legal obligations related to the services.
- You represent that you have all rights and permissions needed to submit User Content and authorize Lukhoo to process it.
Prohibited Conduct
- Do not use Lukhoo for unlawful surveillance, harassment, stalking, threats, intimidation, impersonation, fraud, exploitation, or invasion of privacy.
- Do not upload malware, attempt unauthorized access, interfere with the services, reverse engineer non-public software, scrape systems, or bypass security controls.
- Do not submit false, misleading, defamatory, obscene, violent, discriminatory, or infringing content.
- Do not use Lukhoo in a way that creates unreasonable risk to any person, interferes with emergency responders, or violates court orders or legal restrictions.
Payments, Subscriptions, and Third-Party Charges
- If paid services are offered, pricing, renewal, cancellation, and refund terms will be disclosed at purchase or in the applicable checkout flow.
- Third-party app stores, payment processors, wireless carriers, attorneys, or service providers may charge separate fees and apply their own terms.
- Unless required by law or expressly stated otherwise, fees already paid are non-refundable.
Privacy and Data Protection
Your use of Lukhoo is also governed by our Privacy Policy and Client Data Privacy Policy. Those policies describe the categories of information we collect, how we use and disclose it, how long we keep it, and how users may exercise applicable privacy rights.
Third-Party Services
Lukhoo may rely on third-party hosting, storage, maps, analytics, communications, transcription, payment, app store, identity, or support providers. We do not control third-party services, networks, devices, browsers, app stores, attorneys, or external websites, and we are not responsible for their actions, outages, privacy practices, or terms.
Service Availability and Changes
- Lukhoo may update, suspend, modify, discontinue, or limit any feature at any time, including features formerly branded as Safe-Watcher.
- We do not guarantee uninterrupted service, permanent storage, perfect transcription, exact geolocation, immediate delivery, successful upload, successful sharing, or compatibility with every device, browser, network, or operating system.
- You are responsible for maintaining your own device, battery, connectivity, permissions, backups, and lawful access to your account.
Intellectual Property
Lukhoo LLC owns or licenses all rights in the Lukhoo name, logos, software, designs, workflows, text, graphics, interfaces, databases, and other service materials, except User Content. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the services except as expressly allowed by law or written permission from Lukhoo.
Warranty Disclaimer
To the fullest extent permitted by law, Lukhoo and all related services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, legal sufficiency, evidentiary admissibility, or uninterrupted operation.
Limitation of Liability
To the fullest extent permitted by law, Lukhoo LLC and its owners, officers, employees, contractors, affiliates, vendors, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, lost profits, lost data, lost evidence, loss of goodwill, personal injury, property damage, legal outcomes, attorney conduct, emergency response failures, outages, cyber incidents, third-party acts, or events beyond our reasonable control. To the fullest extent permitted by law, Lukhoo's total liability for any claim will not exceed the greater of the amount you paid to Lukhoo for the services in the three months before the claim arose or $100.
Indemnification
You agree to defend, indemnify, and hold harmless Lukhoo LLC and its owners, officers, employees, contractors, affiliates, vendors, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the services, User Content, violation of these Terms, violation of law, violation of another person's rights, or dispute with a third party.
Governing Law, Arbitration, and Class Waiver
- These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
- Before filing a claim, the parties agree to try in good faith to resolve the dispute informally by written notice and a 30-day resolution period.
- Except for claims that may be brought in small claims court or requests for injunctive relief to protect intellectual property, security, or confidential information, disputes will be resolved by binding individual arbitration in Bexar County, Texas, or another mutually agreed location.
- You and Lukhoo waive the right to a jury trial and agree to bring claims only on an individual basis, not as a plaintiff or class member in a class, collective, consolidated, private attorney general, or representative action, to the fullest extent permitted by law.
Changes to These Terms
We may update these Terms from time to time. The updated version will be effective when posted unless a later date is stated. Continued use of Lukhoo after changes become effective means you accept the updated Terms.
